From 27 February 2026, the Education and Care Services National Law (National Law) requires the safety, rights and best interests of children to be the paramount consideration for all individuals involved in the operation and delivery of children’s education and care.


Whilst this is not a new idea and is grounded in many of the legal frameworks that guide our work in OSHC, it elevates the obligation from a guiding principle under the National Quality Framework (NQF) to a statutory duty. This means it is now a legal requirement that must be followed.


This session will explore what the paramountcy consideration is, the many ways we already enact it in OSHC and how we can further embed it into every decision that we make.
