Primary legal responsibilities under the Education and Care Services National Law Act (2010) and Regulations (2011)

The Education and Care Services National Law Act (2010) and Regulations (2011) require that the Approved Provider operate a compliant and quality service. The Approved Provider have the primary legal responsibility to ensure compliance and consequently must understand their obligations and implement systems and processes including risk minimisation to meet these expectations. The Approved Provider must also identify the Nominated Supervisor for the service, understand the areas of shared liability and provide evidence of that person’s consent to fill the role.

This session will explore the role of the Approved Provider of an OSHC service including how the Approved Provider can manage their responsibilities and obligations under the National Law and Regulations, exercising both management and control to ensure all educators and staff members are aware of and equipped to ensure relevant laws, provisions and standards are followed. The session will cover:

  • Eligibility requirements for the Approved Provider
  • Prescribed Responsibilities for the Approved Provider and Nominated Supervisor (within the Laws and Regulations)
  • Systems and processes to minimise risk and meet operational expectations
  • Policies and Procedures and the 6 step framework for ‘reasonable steps’
  • Appointing the Nominated Supervisor and in their absence ‘Responsible Persons’
  • Considerations when undertaking the role of the Approved Provider including managing instances of non-compliance and consequences
